HIKE + BIKE TERMS AND CONDITIONS
The following is the terms of the agreement between Hike + Bike and each of our customers. If you do not agree to these terms, you should not procure the services of Hike + Bike, so please review these terms carefully. If you have any questions about them please contact us.
You enter into this agreement with Hike + Bike when we receive a specified booking payment or deposit from you.
LIABILITIES
You accept that mountain biking, hiking and road cycling are dangerous activities that can cause serious injury or death.
Hike + Bike activities take place in an outdoor, mountainous environment and are, by their very nature, not free from risk. Hike + Bike makes every effort to minimise the risk to the customer(s) and instructs the customer(s) in the safe negotiation of such risk as may remain. Consequently, while all reasonable efforts will be made to ensure the safety and well-being of our customers because the activities take place in an outdoor/mountain environment the customer(s) must be aware, understand and agree that there are inherent dangers and certain unpredictability accompanying the activities. The customer(s) accepts responsibility for such risks to personal safety. The customer(s) accepts that to that extent he or she is taking part in a Hike + Bike holiday, tour or activity at his or her own risk.
Hike + Bike will not be liable for any injury that results from failure to follow its safety instructions. Hike + Bike only accepts liability for physical injury to a participant that is shown to result from negligence on the part of Hike + Bike. The customer(s) acknowledges that other loss, damage and expense including, without limitation, loss of money, loss or damage to clothes, equipment and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused other than by the negligence of Hike + Bike howsoever arising is not the responsibility of Hike + Bike and that Hike + Bike’s liability is hereby limited.
Customers are required to sign an ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM upon arrival, prior to the tour commencing.
All clients must obey the safety instructions of the guide at all times and agree not to act in any way that compromises the safety, enjoyment, learning or well-being of themselves, other participants, or staff. Hike + Bike reserves the right to withdraw services, without refund, from any participant that does not follow the safety instructions of the guide or in the guide’s judgement poses a safety risk.
Hike + Bike may ask a participant to withdraw from activities, without refund, if they are found, or seem, to suffer from a physical or mental condition that, in the guide’s judgement, poses a threat to safety. If a prospective participant is in any doubt about this they must discuss their condition with Hike + Bike in advance of booking and, if deemed necessary, seek medical advice.
Hike + Bike may ask a participant to withdraw from activities, without refund, if they are found, or seem, to be in very poor physical condition, or of very low personal fitness that, in the guide’s judgement, may compromise group well-being or safety. If a prospective participant is in any doubt about this they must discuss their physical condition with Hike + Bike in advance of booking and, if deemed necessary, to seek medical advice.
Hike + Bike will not tolerate verbal or physical abuse of other guests, our staff, our equipment, our accommodation, local people or the environment. Any breach of this will result in the immediate withdrawal of our services without refund, removal from our premises and may lead to prosecution.
PAYMENT
Hike + Bike requires a deposit of 50% of the total amount to reserve day tours, multi-day tours and holidays. Deposits are refundable at Hike + Bike's discretion and in accordance with Hike + Bike cancellation charges. Any refunds issued in accordance with Hike + Bike cancellation terms will be subject to deductions for any costs incurred by Hike + Bike.
ONLINE BOOKING FEES
Any payments made to Hike + Bike through online booking portals may be subject to a non-refundable booking fee. Booking fees are deducted at source by the booking platform or payment portal providers and are in no way controlled by Hike + Bike. If you do not agree to these terms, you should not procure the services of Hike + Bike through these online portals. Use alternative methods of booking i.e email, contact forms, telephone.
CANCELLATION
(a) Cancellation of a booking by a customer is only effective when received by Hike + Bike in writing by email or in the post. The address to send cancellations to is; Hike + Bike, C/ Sierra de las Cumbres 6, Hacienda los Pinos, 29400 Ronda (Malaga) Spain or email: info@hikeandbikeholidays.com. Phone cancellations will still require written confirmation. The phone number is 0034 638 873 279.
Cancellation charges will be scaled accordingly:

* If non-refundable charges are incurred to a third-party supplier, these may be retained in addition to the cancellation charges as above. If you re-book a holiday with us within 12 months of a cancellation which has incurred a cancellation charge, we will credit 50% of the retained amount to the new holiday, excluding any hotel or other cancellation charges incurred by us.
Change of Dates:
To change the dates of your holiday or multi-day tour after a deposit has been paid, you must notify Hike + Bike at least 15 days prior to arrival. Any rescheduling will be subject to availability and may incur additional charges for administration, accommodation, bikes, equipment, transport etc. We reserve the right to refuse any transfer of holiday dates.

Final holiday payment is due no later than 14 days before your holiday begins. If this is not paid Hike + Bike reserves the right to regard the booking as cancelled and the participant will lose his or her deposit.

(b) Hike + Bike reserves the right in any circumstances to cancel any activities and in this event will return to participants all monies paid. In no case will your activity be cancelled less than two weeks before it begins, except for reasons of injury, war, riots, civil strife, terrorist activity, industrial disputes, natural and nuclear disasters, fire, technical problems to transport, closure or congestion of Airports or ports, cancellations or changes of schedules by scheduled Airlines and similar events beyond the control of Hike + Bike
For day trips, balance payment terms will be agreed with you via email.
We request deposits to confirm to our clients that their activity is booked and a guide/bikes/driver have been reserved.
If the weather conditions are a bit chilly or there is a possibility of showers, this should not spoil most rides or walks, so we continue to run our booked activities as planned, and advise clients on appropriate clothing. In the case of very bad weather, which would make things totally miserable for everyone or make certain activities unsafe, we firstly try to reschedule for another day. If this is not possible (due to either our own or the client's schedule), we may cancel the activity altogether. If we cancel due to the weather, we will refund the deposit. If we feel the weather is fine to continue but you choose to cancel, 100% of the deposit will be retained. Any bike hire security deposit paid will be refunded.
TRAVEL INSURANCE
It is recommended that the customer(s) may take out personal insurance to cover cancellation losses and if travel costs are likely to be high it is advisable to check the availability of your preferred holiday dates before booking travel tickets. Should Hike + Bike have to cancel for any reason, the customer(s) will be offered an alternative date. If this is not acceptable, the booked customer(s) will be eligible for a full refund (deductions for money transfers and exchange rate fluctuations may apply).
Hike + Bike reserves the right to cancel activities without refund when we deem it dangerous to continue or due to combinations of adverse/dangerous environmental conditions. Definitions, including but not limited to: heavy consistent precipitation, floods, earthquakes, landslides, electrical storms (present or imminent) high winds, low visibility, resultant temperatures below 10ºC or above 40ºC, wildfires. Assessments will be made on a daily basis, and ongoing throughout the activity.
Hike + Bike reserves the right to cancel activities without refund due to clients not having their European Health Insurance Card (Applies to EU residents only) and/or proof of adequate personal insurance.
Except where stated differently, Hike + Bike will not be held liable for any compensation, damages, expenses, costs, losses or any other amount of any description or otherwise if we or your airline have to change or cancel your flight or holiday, or your flight cannot be provided as or when agreed as a result of circumstances or an event beyond our control.
In the unlikely event that the customer(s) has/have cause for complaint about Hike + Bike, the complaint should be made in the first instance to the guide so that corrective action can, if possible, be taken. The customer(s) acknowledges that it is unreasonable to take no action during an activity with Hike + Bike but to complain later. However, should a problem not be resolved the complaint should be made in writing.
PROMOTIONAL OFFERS
Hike + Bike promotions using vouchers, leaflets or reference numbers for discounted holidays, services or any other products provided by Hike + Bike will be limited to one use per person. Discount vouchers, reference numbers or leaflets may only be used once per person per booking. The cumulative use of special reductions/offers in prices or discounts will not be admissible when making bookings with Hike + Bike. Date restrictions may apply and offers are subject to availability. Holiday bookings taking advantage of special offers, discounts and promotions are based on 2 people sharing. Single-person bookings will be subject to supplementary charges. All offers do not include flights or bike hire unless stated otherwise.
BIKE HIRE & DAY TOURS
Bookings are necessary to reserve bikes with Hike + Bike. In the peak season you will need to book in advance, especially when cycling events are on. A booking will only be confirmed once you have made full payment of the total rental amount to Hike + Bike.
Bike hire is subject to a security deposit payable before the date of hire. This security deposit is held as security for instances where a bike is damaged beyond reasonable use or wear and tear or for loss of equipment. The deposit is refunded after safe return and inspection of the bike/s. The value of any damage beyond reasonable use or wear and tear or the loss of equipment will be deducted from the security deposit.
If at any time Hike + Bike are requested by the customer to collect or transport the riders, bikes or both where no prior arrangement has been made then a charge will be made and deducted from the security deposit.
Prearranged times for drop off or collection of bikes require prompt attendance by the customer. Delays or late arrivals will be subject to a waiting time charge of €10 per 15 minutes, deductible from the security deposit.
Any customer who withdraws from or cancels a bike rental after a booking has been confirmed will not receive a refund of the deposit. Any refunds will be solely at the discretion of Hike + Bike.
When renting a bike you will be responsible for the bike, at all times, until it is returned to Hike + Bike.
If you rent a bike we expect you will:
1. Show a valid photo ID (passport or driver’s licence) and sign a rental contract.
2. Pay a security deposit when renting a bike (up to 50€ per bike, payable in advance).
3. Make sure you have travel insurance and check the policy before you leave (if it covers theft or damage of a rental bike).
4. Lock your bike to any pole/fence or something secure.
5. Return a clean and undamaged bike.
6. Use the rental bike for what it has been designed for.
7. Use a bike helmet (an obligation in Spain and we will supply the helmet for "free").
8. Be friendly to other road users and give way to pedestrians on zebra crossings.
We recommend that you take out travel insurance when you plan to rent a bike with us in the event that you have to cancel or in case your rental bike becomes damaged or lost (theft). Not all insurance policies include this option, therefore it's best to ask and to pay that little extra for insurance cover.
